Acceptance of terms
By downloading, installing, or using RoundFit (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App.
These Terms constitute a legally binding agreement between you and RoundFit LLC (“we”, “us”, or “our”). We may update these Terms from time to time. If we make material changes, we will notify you by email or in-app notification at least 14 days before those changes take effect. Continued use of the App after updated Terms take effect constitutes your acceptance of the new Terms.
Description of service
RoundFit is a personal nutrition and health intelligence app that helps you track calories and macronutrients, monitor activity and recovery, and receive personalised daily insights. Features include:
- Calorie and macro tracking with AI-assisted food logging
- Daily targets adjusted based on activity, sleep, and recovery data
- Menstrual cycle-aware nutrition guidance for eligible users
- Integration with Apple HealthKit and Google Health Connect
- AI-generated personalised insights for premium subscribers
- Morning check-ins and progress tracking
We reserve the right to modify, suspend, or discontinue any part of the App. Where reasonably practicable, we will provide advance notice of material changes. For paid subscribers, if we discontinue the App entirely, we will issue a pro-rata refund for any unused portion of a prepaid subscription period.
Your account
To use RoundFit you must create an account. You are responsible for:
- Providing accurate information when creating your account
- Keeping your login credentials confidential and secure
- All activity that occurs under your account, whether or not authorised by you
- Notifying us immediately at support@roundfit.com if you suspect unauthorised access to your account
You must be at least 18 years old to create an account. By creating an account you confirm that you meet this age requirement. We reserve the right to terminate accounts that we believe belong to users under 18.
Subscriptions & payments
Free tier
RoundFit offers a free tier with core calorie and macro tracking features. No payment is required to use the free tier.
Premium subscription
Premium features — including AI-generated insights, advanced pattern detection, and cycle-aware nutrition guidance — require a paid subscription. Subscriptions are offered on a monthly or annual basis.
- Subscriptions are managed and billed through the Apple App Store or Google Play Store
- Payment is charged to your App Store or Google Play account at confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
- You can manage and cancel your subscription in your App Store or Google Play account settings
- We do not offer refunds except where required by law or applicable platform refund policies
Nothing in this section limits any statutory rights you have under applicable consumer protection laws in your jurisdiction.
Price changes
We may change subscription prices at any time. If we increase your subscription price we will give you at least 30 days notice before the change takes effect.
Acceptable use
You agree not to use RoundFit in any way that:
- Violates any applicable law or regulation
- Attempts to reverse engineer, decompile, or extract the source code of the App
- Interferes with or disrupts the integrity or performance of the App or its servers
- Attempts to gain unauthorised access to any system or network used by the App
- Uses automated scripts or bots to access or interact with the App
- Shares your account credentials with others or creates multiple accounts to circumvent restrictions
- Submits false, misleading, or inaccurate data in a way that affects other users or our systems
Violation of these rules may result in immediate termination of your account.
Health disclaimer
RoundFit is not a medical service. Nothing in the App constitutes medical advice, diagnosis, or treatment.
The calorie targets, macro recommendations, and insights provided by RoundFit are based on general nutritional science and the data you provide. They are intended for general informational and wellness purposes only.
You should consult a qualified healthcare professional before making significant changes to your diet or exercise routine, especially if you:
- Have or suspect any medical condition
- Are pregnant or breastfeeding
- Take any medication that may be affected by diet or exercise
- Have a history of or are at risk of an eating disorder
- Are managing hormonal conditions or are taking hormonal contraceptives
Regarding cycle-aware guidance specifically: Menstrual cycle-aware nutrition guidance provided by the App is based on general nutritional research and population-level data. It does not account for individual hormonal conditions, contraceptive use, irregular cycles, or related medical factors. This guidance is not a substitute for advice from a qualified healthcare provider.
You use the App and act on its recommendations entirely at your own risk.
AI-generated content
Premium subscribers receive personalised insights generated by AI. While we strive to make these insights accurate and helpful, AI-generated content has inherent limitations:
- AI insights are generated based on the data you log — inaccurate data will produce inaccurate insights
- AI insights are not a substitute for professional medical, nutritional, or fitness advice
- AI models may occasionally produce incorrect or misleading output — always apply your own judgement
We are not liable for any decisions you make based on AI-generated content in the App.
Intellectual property
All content, code, design, trademarks, and materials in RoundFit are owned by or licensed to RoundFit LLC and are protected by applicable intellectual property laws. RoundFit is a trademark of RoundFit LLC. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes in accordance with these Terms.
You retain ownership of the data you enter into the App. By submitting data, you grant RoundFit LLC a non-exclusive, worldwide, royalty-free licence solely to operate, maintain, and deliver the Service to you, as described in our Privacy Policy. We do not use your personal health data to train or fine-tune AI models without your explicit opt-in consent.
You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.
Privacy
Your use of RoundFit is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it — it explains exactly what data we collect, how we use it, and your rights over it.
Sensitive health and reproductive data: We treat menstrual cycle data, biometric data, heart rate variability, and related health data as sensitive personal information. We do not sell this data to third parties, share it with advertisers, or disclose it to law enforcement or government agencies without a valid court order or as otherwise required by law.
Disclaimers
The App is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties including:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the App will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy or completeness of any content
- Warranties that defects will be corrected
Third-party integrations: We make no warranties regarding the accuracy, completeness, or availability of data received from third-party integrations including Apple HealthKit, Google Health Connect, or connected wearable devices. Readiness scores and related recommendations are dependent on the quality of data provided by these platforms and may not reflect your actual physiological state.
We do not warrant that the App will meet your specific requirements or that results obtained from using the App will be accurate or reliable.
Limitation of liability
To the fullest extent permitted by applicable law, RoundFit LLC and its members, managers, employees, and agents will not be liable to you for:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, revenue, data, goodwill, or other intangible losses
- Any damages resulting from your use of or inability to use the App
- Any decisions made based on information or insights provided by the App
- Any inaccuracies in data received from third-party platforms or wearable devices
Our total liability to you for any claim arising out of or relating to these Terms or the App is limited to the amount you paid us in the 12 months prior to the claim arising, or $50 USD (whichever is greater).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold harmless RoundFit LLC and its members, managers, employees, and agents from any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or relating to your use of the App, your violation of these Terms, or your violation of any third-party rights.
Termination
You may stop using the App and delete your account at any time from the profile settings screen. Upon account deletion, we will delete or anonymise your personal data within 30 days, except where retention is required by applicable law.
We may suspend or terminate your access to the App at any time, with reasonable notice where practicable, if:
- You violate these Terms
- We are required to do so by law or a regulatory authority
- We reasonably believe your use poses a risk to us, other users, or third parties
- We decide to discontinue the App or any part of it
Upon termination for reasons within your control, your right to use the App ceases immediately. Paid subscribers terminated for reasons outside their control are entitled to a pro-rata refund for any unused prepaid subscription period. Sections of these Terms that by their nature should survive termination will do so, including the health disclaimer, disclaimers, limitation of liability, and governing law.
Dispute resolution
Informal resolution: Before initiating any formal dispute, you agree to contact us at legal@roundfit.com and give us 30 days to attempt to resolve the matter informally.
Binding arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.
Class action waiver: You agree that any arbitration or proceeding shall be limited to the dispute between you and RoundFit LLC individually. To the fullest extent permitted by law, you waive the right to participate in a class action, class-wide arbitration, or any other representative proceeding.
Small claims: Notwithstanding the above, either party may bring an individual claim in small claims court if it qualifies.
Exception for injunctive relief: Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement or misuse of intellectual property.
Governing law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Subject to the arbitration clause above, any disputes not subject to arbitration shall be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
If you are a consumer resident in the European Union, you may also benefit from any mandatory provisions of the law of the country in which you reside.
Force majeure
RoundFit LLC shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to: changes to Apple App Store or Google Play Store policies, Apple HealthKit or Google Health Connect API changes or outages, third-party infrastructure failures, acts of government or regulatory authority, natural disasters, or other events outside our reasonable control. We will use reasonable efforts to resume normal service as quickly as practicable.
Changes to these terms
We may update these Terms from time to time. If we make material changes we will notify you via email or an in-app notification at least 14 days before the changes take effect. The date at the top of this page shows when the Terms were last updated.
Continued use of the App after updated Terms take effect constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the App and delete your account before they take effect.
